Three charities in breach of counter-terrorism regulations, Treasury watchdog says
Three charities have breached counter-terrorism regulations after failing to respond to requests for information, the Treasury watchdog has said.
The Office of Financial Sanctions Implementations requested information from the environmental charity Impact Planet, the poverty relief charity Sahara Hands and the religious charity Peculiar People’s Palace Ministries.
The charities failed to respond to the OFSI after several requests for information, which hindered the regulator’s ability to monitor compliance on counter terrorism regulations.
The OFSI said this failure to respond amounted to regulatory breaches.
In a report about the breach, the OFSI, which is part of the Treasury, said it does not view the cases as “sufficiently serious” to impose a monetary penalty.
“However, the nature and circumstances of this breach were assessed as moderately severe and in OFSI’s judgement publishing a disclosure is the appropriate and proportionate enforcement response,” the report said.
The Treasury watchdog said it contacted the charities on three separate occasions by post and email but it did not receive a response.
A repeated failure to respond to letters and a lack of engagement hindering the OFSI’s ability to monitor compliance with regulations were cited as aggravating factors in the watchdog’s decision to publish the disclosure.
“The OFSI also considered any potentially mitigating factors when reaching its decision to publish this disclosure,” the report said.
“Although OFSI recognises the possibility that a lack of engagement from the charities may be a result of them failing to update their contact information on the register, OFSI does not consider this to be a mitigating factor.”
The OFSI said that all other charities it contacted complied with the regulations by providing the requested information, adding that this disclosure represents a “small minority”.
